ONLINE STORE TERMS AND CONDITIONS ROTO-TECH – Sale of Polyethylene Boats §1. General Provisions These Terms and Conditions define the rules for using the online store operated at: [web address not provided]. Definitions Buyer – a natural person, legal entity, or organizational unit making a purchase in the store. Consumer – a natural person making a purchase not directly related to their business or professional activity. Store – the online store operated by Symmetria Sp. z o.o. Goods – polyethylene boats and accessories offered by the Store. §3. Placing Orders Orders can be placed 24/7 via the order form on the Store’s website or via email. To place an order, the following steps are required: a) Send an email with the order or fill in the online order form, b) Complete the order form, c) Select the delivery and payment method, d) Confirm the order. An order becomes binding once confirmed by the Seller. §4. Prices and Payments All prices are given in Polish zloty (PLN) and include VAT. Available payment methods: bank transfer, installment payment, cash on personal pickup. A proof of purchase (invoice or receipt) is issued for each order. §5. Delivery Delivery is carried out within the territory of Poland. Delivery cost is indicated at the time of placing the order. The standard fulfillment time is between 2 to 6 weeks from the moment the payment is received. §6. Withdrawal from the Agreement (applies to Consumers) According to Article 38 of the Act of 30 May 2014 on Consumer Rights, the Consumer is not entitled to withdraw from the agreement in cases of: “Contracts for the supply of goods that are not prefabricated, made to the consumer’s specifications or clearly personalized.” The polyethylene boats offered in the Store are made to individual order, according to the technical specifications and preferences provided by the Client – therefore, the right of withdrawal does not apply. Before confirming the order, the Client should carefully review the boat’s specifications and accept the offer. Errors in the order resulting from incorrect data or specifications provided by the Client will not constitute grounds for withdrawal. §7. Complaints The Seller is obliged to deliver goods compliant with the contract. Complaints can be submitted via email or in writing. A complaint should include: the customer’s full name, a description of the defect, and the Client’s request. Complaints are reviewed within 14 days. §8. Personal Data The personal data controller is Symmetria Sp. z o.o. Personal data is processed for the purpose of fulfilling the order and is not shared with third parties, except for entities involved in order fulfillment (e.g., courier companies). The Buyer has the right to access, correct, and delete their data. §9. Final Provisions In matters not regulated by these Terms and Conditions, the provisions of the Civil Code, the Consumer Rights Act, and the GDPR shall apply. The Seller reserves the right to amend these Terms and Conditions. Changes become effective upon publication on the website. These Terms and Conditions are effective as of May 6, 2025.
